The A&DC Group Limited (hereafter known as "A&DC") hereby grants you authorised access to the pages on this Website, including all assessment tests, surveys, questionnaires, other products, information, documents, communications, files, text, graphics and software available on or through the Website (collectively, the "Material" or "Materials") and all services operated by A&DC and third parties (the "Services") on or through the Website, conditional upon your agreement to accept the application of local, state, national and/or international law or any regulations having the force of law to govern matters between us in relation to this Website (please refer to the Terms of Use).

This statement covers the Materials and Services provided by the A&DC Websites: apolloadmin.adc.uk.com and apolloassessment.adc.uk.com.  It describes how we collect, protect and use information we receive from visitors to these Websites.  These Websites are owned and operated by A&DC.

A "Client" (or "Clients") means the company, organisation, business, individual or any other person (legal or natural) purchasing our Materials and/or Services (who may, or may not, also be a Registered User).  By purchasing our Materials and Services, a Client agrees to the terms of this Privacy Policy.

A "Participant" (or "Participants") means the individual who engages in completing the assessment tests, surveys, questionnaires or other products on the Website at apolloassessment.adc.uk.com for the purposes that are published from time to time.  By using these Materials and Services, a Participant agrees to the terms of this Privacy Policy.

Please read these terms carefully before using this Website or submitting your personal data to us.  Using this Website or otherwise submitting your personal data to us or agreeing to submit your personal data to us indicates that you accept the terms of this Privacy Policy.

2.0     Privacy Policy

Please read the following Privacy Policy to understand how we use and protect the information that you provide to us.  Notwithstanding the provisions of this Privacy Policy a person, including a Client or Participant, using the Website or otherwise submitting data to us shall have no greater rights under this policy than the person would have under the applicable laws of their place of residence.

By registering with us, by completing any of the assessment tests, surveys, questionnaires or other products on this Website or by submitting your personal data in any other way,  you consent to the collection, use and transfer of your information under the terms of this Privacy Policy.  However, if at any time you have any queries or concerns about our use of your personal information, please contact us.  Our full contact details are at the end of this notice.

SENSITIVE PERSONAL DATA: WE WISH TO DRAW YOUR ATTENTION TO THE FACT THAT AS PART OF OUR COLLECTION OF DATA, YOU WILL BE ASKED TO PROVIDE US WITH SOME SENSITIVE PERSONAL DATA AS DEFINED BY THE DATA PROTECTION ACT 1998.

A&DC is committed to protecting your privacy and to ensuring that we handle any personal data with care, respect and in accordance with legal requirements.  In order to do this, we have implemented a number of technical and organisational procedures, which safeguard everyone's interests.

3.0     Information Collection and Use

A&DC is a company that provides talent management solutions for use in various human resource management processes such as recruitment, selection, learning and development.  We design and use talent management tools (including but not restricted to the assessment of individuals’ abilities, motives and competencies) to meet our Clients’ needs and for our own research purposes.

When you visit the Website you may be asked to provide certain information about yourself including but not restricted to your name, contact details, gender, age, other personal details and details regarding your employment, as well as to create and/or maintain a user name and password.

We may use your personal information for the following purposes: accounting, billing and audit, credit or other payment card verification, security, administrative and legal purposes, systems testing, maintenance and product development, customer relations, in carrying out obligations under contracts entered into between you and us and to help us in any future dealings with you.

Your personal information may be used to provide reports and services to our Clients and to you if you are a Participant.  These reports and services may be used by our Clients in the selection and development of individuals in a recruitment, selection or employment context.  Personally identifiable information about a Participant will only be made accessible to a Client when the Participant completes an assessment test, survey, questionnaire or other product on this Website in order to gain employment with that Client or as part of a selection, development or survey activity in their current employment with the Client.  In addition to containing personally identifiable information about Participants, reports and services provided to such Clients or generated by Clients, our associated companies and approved agents, may include scores, statistics or personal profiles derived from Participants’ individual or composite test, survey or questionnaire results. 

Participant data may also be used for our own research purposes.   Examples include but are not restricted to generating norm groups and conducting statistical research to examine the reliability, validity and adverse impact of our Materials and Services.  We may also use Participant data in the development of new Materials and Services both for our own use and by third parties.

Information we collect about you, but which does not identify you personally, may be passed to other companies within A&DC or its approved agents, current or future potential Clients or research institutions that may use such information for some of the purposes set out above.  Such companies may be located in countries outside the UK, which do not have data protection laws to protect your information. 

Supplying your data to such companies may also result in your data being transferred to, and stored at, a destination outside the European Economic Area ("EEA").  It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers.  We also collect the domain names, email address and other personal data of those who communicate with us.

We do not collect information about our visitors from other sources, such as public records or private organisations, or use personal data for any purpose other than those listed above.  We will always ask you when we need information that personally identifies you or allows us to contact you.  If we wish to use your personal data for a new purpose, we offer you the means to consent by indicating in a box at the point on the Website where personal data is collected.

The A&DC Group Limited is notified in the UK under the Data Protection Act (1998).

4.0     Information Disclosure

Your personal information will be used solely for the purpose of providing you with any Materials and Services you have purchased or requested; monitoring and improving the quality of our Materials and Services; or for publishing market surveys or academic research.  The information you give will be used in accordance with relevant state, national and international legislation covering data protection and freedom of information.

A&DC will not disclose the information you provide to any third party for any other purpose other than those listed above without your prior written consent, unless we feel such disclosure is necessary or appropriate to (a) comply with a court order or other legal process; (b) protect our rights or property; (c) limit our potential legal liability; (d) enforce other policies that are part of this Website; or (e) comply with an audit request.

Your personal details will not be sold or traded to third parties.  In the event of A&DC going through a merger, acquisition or partial sale of its assets, users’ personal information will, in most cases, be treated as part of the assets transferred.  In our case, under these circumstances you would have the right to access and/or delete your personal information (see below).

When you use the Materials and Services provided on this Website, such as completing an assessment test, survey or questionnaire, we may request or you may volunteer contact details of a third party for confirmation of your information.  It is your responsibility to inform any third party, whose contact details and personal information you provide to us, that you have disclosed this information.  You should obtain the prior consent of any such third party before disclosing their personal information.

If we have contacted you as a result of your details being disclosed to us by a Participant, we confirm that we will use your personal details and any information that you subsequently submit to us in accordance with this Privacy Policy.

Unfortunately, the transmission of information via the Internet is not completely secure, and we therefore cannot guarantee the security of your data transmitted to our Website; any transmission is at your own risk.

7.0     Website Usage Information

7.1     Cookies

A cookie is a small file which is stored on your computer's hard disk when you visit a website and will typically record a user's preferences.  Session cookies are used for remembering, temporarily, information about your current access to the Website.  These cookies will be stored only for the duration of the browser session plus 30 minutes, and help to improve the speed of response whilst you access the Website.  A cookie contains no personally identifiable information.  You may refuse cookies by turning them off on your web browser at the expense of a slightly degraded service.

7.6     User Submissions

Please do not post confidential or proprietary information to our Website.  Any material, information or any other communication you transmit or post to our Website will be considered non-confidential and non-proprietary and we will have no liability for it.  A&DC and its designees will be free to copy, disclose, distribute, incorporate and otherwise use the communications in all data, images, sound, text and other things embodied therein for any and all commercial or non-commercial purposes. Users of our Website are prohibited from posting or transmitting to or from this Website any unlawful, threatening, libellous, defamatory, obscene, pornographic or other material that would violate any law (please refer to the Terms of Use).

7.7     Retention and Storage of your Information

We generally keep your personal details indefinitely for the purposes that we have mentioned above.  However in certain circumstances we may destroy or delete any of your personal information that we hold.  If you complete an assessment test, survey, questionnaire or other product on this Website as a Participant to gain employment with a Client or as part of a selection, development or survey activity in your current employment with a Client, then that Client may retain personally identifiable sensitive information about you as defined by the Data Protection Act 1998. 

A&DC is not responsible for the privacy practices of our Clients, including their policies on the retention and storage of Participant information.  However, we do expect all Clients who use this Website to comply with our Privacy Policy in respect of using the Materials and Services and also to abide by relevant standards set by professional bodies. 

Please note that our policies on privacy will be overridden where we are required or permitted to disclose personal information under law or the terms of any court order.

8.0     Access to your Personal Information

You may contact A&DC if you would like to gain access to, or modify your personal information held by us to ensure that it is accurate and kept up-to-date.  You can write to the address shown below.  We will not charge for responding to such a request, unless we incur costs in providing the information, in which case we will communicate the fee in advance of providing the information.

Requests can be submitted to the above address by printing and completing a Personal Information Request Form (55KB PDF).  This form will help you to give us all the necessary information to enable us to comply with your request.  Alternatively, you can submit your request by email to: PrivacyOfficer@adc.uk.com.

Requests made by email must include all information from the Personal Information Request Form. The email request must be followed up with written proof of identity (see below).  Please note that the period of 40 days in which A&DC must respond to the request will not commence until we have received written proof of your identity.

Proof of identity should be signed and dated by you and sent to the address above with a stamped addressed envelope so that we can send you the information requested.  Alternatively, at your request, we can email the information to you.

We will respond to your request within forty days of receipt, or if later within forty days of receiving the fee (if required) and the information needed to verify your identity and locate the information you seek.

9.0     Complaints Resolution

We are committed to providing a fair and efficient process for handling and resolving complaints concerning the use of personal information.  You have a right to complain and to have your complaint dealt with properly and in accordance with legal requirements.  We believe that any complaint that we may receive is a valuable opportunity to improve our Materials and Services and to build customer loyalty to our brand.

If at any time you wish to make a complaint in respect of the processing, use or disclosure of your personal information by us, you may do so by contacting our Privacy Officer either by sending an email to PrivacyOfficer@adc.uk.com or at the address below.  We aim to investigate and advise you of the outcome of the complaint promptly.  If you are not satisfied with our response in any way, you may contact your local data protection registrar.

10.0   Severability/Waiver

If any provision of this Privacy Policy is declared unlawful, void, or unenforceable, then that provision shall be limited to the extent enforceable, or otherwise severed, and will not affect the validity and enforceability of the remaining provisions.  Our failure to act with respect to a breach by you or others does not waive our rights to act with respect to subsequent or similar breaches. 

11.0     Entire Agreement    

This Privacy Policy, together with our Terms of Business, Terms of Use, Copyright Statement and Disclaimer constitutes the entire agreement between you and us in relation to your use of our Website, Materials and Services, and supersedes all previous agreements in respect of your use of our Website, Materials and Services.

12.0   Law/Jurisdiction

This Privacy Policy will be governed by and construed in accordance with English law, and any disputes relating to this Privacy Policy will be subject to the non-exclusive jurisdiction of the Courts of England and Wales.
